












SENATE CONCURRENT RESOLUTION NO. 29

Requesting the Joint Committee on Government and Finance to make a
study of the Board of Risk and Insurance Management in and for
the State of West Virginia

Whereas, The Legislature is ultimately responsible for the
fiscal integrity of the state's property and liability insurance
program; and

Whereas, The Legislature believes that a thorough examination
of the state's property and liability insurance program would be
prudent and advantageous in assisting the Legislature to make sound
fiscal and policy decisions regarding the state's property and
liability insurance program; therefore, be it

Resolved by the Legislature of West Virginia:

That the Joint Committee on Government and Finance is hereby
directed to review, examine and study the Board of Risk and
Insurance Management. The study should include, but is not limited
to, whether to eliminate the process of the Board of Risk and
Insurance Management staff allocating general revenue
appropriations to state agency insureds; exploring the use of a
multi-year premium with modifiers for experience to improve
accountability; evaluate the deductible levels for property insurance and whether self-insured retention should be established
for liability policies; revisit the participation of the Senate
Bill No. 3 entities and the possible effects of adverse selection;
study the efficacy of issuing "claims made" policies versus
"occurrence" policies; benchmark the Board of Risk and Insurance
Management's operations against other insurance entities; and, be
it

Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 2001, on
its findings, conclusions and recommendations, together with drafts
of any legislation necessary to effectuate its recommendations;
and, be it

Further Resolved, That the expenses necessary to conduct this
study, to prepare a report and to draft necessary legislation be
paid from legislative appropriations to the Joint Committee on
Government and Finance.
